Global Gaps Threaten the Future of Space Operations
Over recent decades, national governments have built domestic legal frameworks to regulate and protect their citizens and companies engaged in space activity. These mechanisms have supported a remarkable expansion of human presence beyond Earth without major disputes. Yet, as commercial and governmental ventures multiply, national laws are reaching their limits. The challenge arises when domestic regulation intersects with obligations under international space law, risking conflicts that could undermine both compliance and innovation.

International space law governs the conduct of nation states themselves, forming the overarching legal architecture for activities beyond Earth. The foundation of this framework lies in the Outer Space Treaty (OST) and related agreements, negotiated in an era when today’s technological realities were unimaginable. While national legislation has evolved alongside new missions and industries, the international regime has remained largely static, leaving significant gaps.
One of the most pressing deficiencies is the absence of binding global rules on space debris. As orbital traffic grows, the lack of coordinated regulation threatens both safety and sustainability. Liability provisions are similarly limited, offering scant clarity for incidents involving private operators or multinational ventures. According to Rachael O’Grady of Mayer Brown International LLP, these gaps must be addressed at the international level to be effective: without binding obligations on all states, domestic measures will have little impact.
The commercialization of space exposes further mismatches between treaty provisions and modern practice. Under the OST, any “stations, installations, equipment and space vehicles” on celestial bodies must remain open to inspection by representatives of other state parties. For industries reliant on proprietary technology and trade secrets, such openness is commercially untenable. More contentious still is the treaty’s prohibition on ownership of space resources. While logical during the Cold War, this restriction now collides with emerging interest in extraterrestrial mining as terrestrial resources diminish. Without updated rules, the prospect of a disorderly scramble for lunar or asteroid materials looms.
Interpretations of Article II of the OST illustrate the problem. The article states: “Outer space, including the Moon and other celestial bodies, is not subject to national appropriation by claim of sovereignty, by means of use or occupation, or by any other means.” Some read this as a blanket ban on ownership of extracted resources. Others argue that it only prohibits territorial claims, leaving room for private or corporate exploitation. These opposing views, driven by differing political and commercial agendas, highlight the urgent need for clarity.
Several nations have already acted unilaterally, passing laws that grant their citizens rights to resources obtained in space. While these measures provide domestic certainty, they risk fragmenting the global legal landscape. Divergent national statutes on matters of international concern make consensus harder to achieve and could foster conflicting claims in the future.
The engineering community understands that technology without governance can lead to instability. Just as orbital mechanics require precise calculations to maintain stability, the legal architecture of space must be coherent to support sustainable growth. The absence of updated international agreements leaves operators navigating a patchwork of rules, increasing risk and complicating investment decisions.
Historically, major advances in aerospace—such as air traffic control systems or satellite frequency coordination—have been accompanied by corresponding regulatory evolution. The same principle applies to space law. The ability to land rovers on Mars or deploy mega-constellations in low Earth orbit demonstrates extraordinary technical capability. Matching that with legal frameworks fit for the modern era is both possible and necessary.
As activity accelerates, the stakes grow. Without reform, the gaps in international space law will become fault lines, potentially undermining safety, commercial viability, and cooperative exploration. The tools to address these challenges exist; what remains is the political will to align them with the realities of twenty-first century space operations.
